This consignment agreement represents the contract between the Consignor and Rags to Riches (R2R). We specialize in high end & designers items that you would find at finer retail stores such as Bloomingdales, Neiman Marcus, Saks Fifth Avenue and the exclusive boutiques of Palm Beach, New York, California & International, etc. If you are unsure if we would or would not take a specific designer, simply email us (ragstorichesresale@comcast.net) and we would be glad to let you know. Current effective contracts are available at www.RagsToRichesResale.com Condition of Accepted Items: We specialize in high end / designers that you would find at finer retail stores such as Bloomingdales, Neiman Marcus, Saks Fifth Avenue and the exclusive boutiques of Palm Beach, New York, California & International. Clothing must be in NEW, or LIKE NEW condition only. Only current styles (maximum of 2 years old) or vintage are acceptable. Items must be from a smoke-free environment. Consignor certifies that clothing has been professionally dry cleaned prior to being consigned. If an item is determined to be in need of cleaning, a cleaning fee will be charged. Limit of 20 items per drop off. Lawful Owner: By signing this agreement and consigning items for sale at R2R, you guarantee that all items given to you are lawfully and entirely owned by you, or you are acting on behalf of someone who has given you authority to consign the items on their behalf. Authenticity of Merchandise: Only original, authentic designer items are accepted for consignment. By submitting items for consignment, you the consignor certify that the items are genuine and authentic. R2R diligently attempts to verify the authenticity of an item before consigning them for sale. If an item is taken on consignment and then found to be a fake, the consignor will be notified and will have 3 days to pick up the item. If the item is not picked up in 3 days, R2R reserves the right to dispose of the item with no liability to R2R. Consignment Period*: Consignment period for seasonal day clothing items is 60 days. Seasonal items will remain at initial assigned price for 30 days. After 30 days, items will be marked down by 50%. If the item is still not sold in the 60 day contract period, goods become property of R2R and are donated to one of our partner charities depending on the item. Due to the volume of merchandise processed, day clothing items cannot/will not be returned. Our goal is to provide direct aid in donating items. Some charities include substance abuse homes, domestic violence shelters, and direct aid for disaster victims. Specialty items include handbags, shoes, jewelry, gowns, vintage and collectibles. These items are reviewed on an individual basis. Consignment period on these items is seasonal and remain for the season. <ul> <li>Consignment period subject to change without notice due to stock fluctuations, seasons, sales, etc.</li> </ul> Pricing: R2R reserves the right to set the pricing on items. R2R will work with the consignor on pricing of special items, but R2R is a member of the National Association of Professional Appraisers and has extensive experience as to the best pricing on consignments. Seasonal items will remain at initial assigned price for 30 days. After that period, items will be marked down by 50%. Specialty items such as handbags, shoes, jewelry, gowns, etc, are marked down independently as stock and season dictates. There are two season clearances where most store items are 50% off. Winter clearance is in March. Summer clearance is August. Payment / Percentage Split: Forty percent of the selling price will be paid to the consignor. Checks over $50 are mailed at the end of the consignment period. Account balance can be used at any time for store credit. Consignors have the option to establish an “open account” where funds remain on account for use on purchases made in the store. If a stop payment of the check is requested for any reason, the consignor will pay the $30 stop check fee. Resale for Charity: R2R conducts fund raisers for local charities. The proceeds from the sale of your items will go to the charity. Or, we will set up an account in the name of the charity of your choice and your portion of the sale of your items will go directly to them. Liability on Merchandise: R2R does not provide any type of insurance or guarantee to consignors for items placed on consignment or left on the premises that covers any loss or damage to the consignor’s property. Please maintain coverage on your personal homeowner’s policy. R2R is not responsible for any loss resulting from theft, damages while a customer is trying on a garment, fire, sprinklers, flood, earthquake, stains, tears, missing pieces or any other damage whether man-made or natural. By consigning your items, you agree to these terms. Sales Returns: All sales are final. Acceptance of Consignment Terms and Conditions: By signing this agreement, you authorize R2R to open a consignment account in your name. You further certify that you understand and agree to the terms and conditions outlined on pages 1 & 2 of this agreement.
